1. Request and quote
Submitting a form, document, or email constitutes only a request for assessment or a quote and does not amount to acceptance of an assignment or confirmation of availability, price, or deadline. ARINCS may accept or decline a request based in particular on its nature, the expertise required, availability, deadlines, and applicable professional obligations. The quote states the scope of the assignment, fees, taxes, deadline, delivery method, and any special terms.
2. Formation of the assignment
Unless otherwise stated, the assignment is formed upon receipt of the signed quote and any required initial payment. Changes to scope may result in revised fees or deadlines.
3. Client documents and information
The client provides complete, legible, and accurate documents, useful instructions, the target language, the context in which the service will be used, and the required date. The client confirms authorization to disclose the documents and information supplied.
4. Fees and payment
Fees may be calculated by word, page, hour, flat amount, half-day, or day. Applicable taxes, expenses, travel, delivery, urgent-service, or cancellation charges are stated in the quote.
5. Deadlines
The deadline begins once all elements needed to start the assignment have been received. Missing information, a scope change, force majeure, or circumstances beyond ARINCS’s reasonable control may change the schedule.
6. Review and corrections
Questions concerning a translation should be reported within a reasonable time with a clear explanation. Corrections within the agreed scope are assessed. Changes to the source document or new preferences may constitute additional work.
7. Receiving institution requirements
Before ordering, the client should verify the institution’s exact requirements, including language, format, paper copy, original document, legalization, or other formalities. ARINCS provides the service according to the agreed assignment and applicable professional requirements but cannot control the institution’s internal policy or administrative decision.
8. Interpreting
The quote states the date, duration, location or platform, languages, and cancellation terms. Waiting time, extensions, travel, and related expenses may be billed in accordance with the quote.
9. Confidentiality
ARINCS handles documents and information in accordance with professional obligations and the privacy policy. The client must use a transmission method appropriate to the sensitivity of the document.
10. Liability
ARINCS performs the assignment with diligence and in accordance with applicable professional obligations. ARINCS remains liable, in accordance with the law, for proven direct damage resulting from a fault committed in performing the assignment.
However, ARINCS is not responsible for consequences attributable to inaccurate, incomplete or late information or documents provided by the client, to any modification made to the translation after delivery without ARINCS’s consent, or to the decisions, internal policies or requirements of a third-party institution that are beyond ARINCS’s control.
Nothing in these terms excludes or limits liability where such exclusion or limitation is prohibited by law, including in cases of intentional or gross fault, bodily or moral injury, or limits the client’s mandatory rights or applicable professional obligations.
11. Intellectual property
The client retains the rights it holds in the source documents. Subject to full payment, the client may use the translation in accordance with the rights it holds in the source document and applicable laws.
ARINCS retains its rights in the tools, templates, methods, glossaries, terminology databases, and other pre-existing materials used in carrying out the engagement. Unless authorized, these materials are not transferred to the client.
12. Governing law
These terms are governed by the applicable laws of Québec and Canada. Mandatory consumer rights remain applicable where provided by law.
